Default HOV Violation for Changing Lanes

My question involves a traffic ticket from the state of: Virginia

I was pulled over today for a HOV violation on 66 (1 mile away from 495). The far left lane is HOV only. I know this...i was in the center lane and a car was stopped trying to get into the right lane and so I passed him on the left. By doing so, I entered into the HOV lane and the cop pulled me over for HOV violation. I was in the HOV for 10seconds maybe. This is my first offense. Should I fight it in court or not waste my time and just pay? Its a $200 fine.

You can try based on the fact that you were in the lane a short amount of time I have seen the judge dismiss cases such as that. However, you were in violation of the law. Just because a vehicle was slowed or stopped in your proper lane of travel doesn't give you the right to use the restricted lane unless directed by law enforcement personnel. You could have slowed or stopped your own vehicle to maintain the proper lane of travel.

There doesn't ever seem to be any reason (other than wasting your own time) to show up in GDC and hope for the best. While it varies greatly from judge to judge, some might waive the fine (you still pay the costs) if your record is good. You never know, you might get a softie or the citing officer may not appear.
Using the HOV lane as a passing lane is a violation (and for good reason, too).

why dont you try to appear by mail? i was pulled over by a motorcop by violating HOV and cross double yellow lines. The ticket was $951. I decided to request an TR-215 and made up a story. Just received the letter from the court and they dismiss my case and will return the check. Fight for your ticket first because you have nothing to lose. Good luck man

So you committed perjury and by extension are suggesting the OP do the same. Brilliant. You do know those are considered sown statements, under oath and penalty of perjury right?

And what makes you think that a form TR-215 (a California form) would work for Virginia?
I am right 97% of the time... Who cares about the other 4%!
