    Default How Can I Get Emancipated

    My question involves emancipation laws for the State of: florida .
    im 16 turning 17 , i do have a job an have found a place i could stay in with my monthly income . i go to high school an plan to go to a community college then to air force or ucf . i have been living with my mother who has never supported me in any way . i have been thru a lot in my life an im am changing an fixing every situation the best i can , my mother is a manipulator an user . i come from school an sometimes so exhausted i cannot sleep . she always has had me over working at home then i leave to work come back hear her complain an lies an just ruin my self confidence . my father is a person i cannot stand to be around or even listen to , i have many situations with him , verbally an physically . an my mom is well aware of how i cannot be around him , i am scared , upset , depressed an anticipated to leave . i have a very bad health problem an my mom an dad just keep making it worse . my mother refuses to take me to the doctors with all the pain i get . my grandmother is the one to force her an in the past i have even had so much pain that she ignored that it soon became a seizure . my education history was pretty bad , but has recently gone way up . i am focused an determined i just need to stay away from all of this an i know i will succeed .

    The state of Florida requires the PARENT to file for emancipation.

    If your mother won't do that, that's the end of the mater.

    If you are being abused, talk to your school counselor or child protective services.

    You will not succeed in becoming emancipated if you cannot a) get your parent/s to file and b) PROVE to the court that you can fully support yourself. That means being able to pay full market rent, utilities, health insurance, food, clothing, transportation, incidentals - all while maintaining good grades.

    In the state of Florida, it's your PARENTS that must initiate an emancipation petition. If they don't do it, it doesn't happen. Period, end of story, no loopholes or special pleadings.

    Even if that were not the case, you're not a candidate for emancipation. Without a full time job and proven track record of supporting yourself 100% - and that means all by yourself, no help, no staying with friends - it doesn't happen. No state in the Union will emancipate someone who cannot support themselves.

    my mother will not , but is there any way i could have the rest of my family do it for me ? as in grandmother grandfather aunt etc . who are the people who have raised me more then she has . an yes i am able to pay all of that .

    What job do you have which enables you to do that while remaining in school?

    Not that it matters, really - if your legal guardians (your PARENTS) won't file, then you're out of luck period.

    my aunt owns a hotel bussiness , and i work for her . i also have another job at home . which i get paid usually for at home 200 an up a week , an at the hotel 600 a week .

    And you're still full time in school?

    Florida will. Their primary concern is the best interest of the minor child. If the court is convinced that the needs of the minor with respect to food, shelter, clothing, medical care, and other necessities will be met, regardless of whether the minor is the person meeting those needs, then the court may grant emancipation.
