    Default Crime of Adultery in Illinois

    My husband and I have been married 6 1/2 years. He has been unfaithful to me since the beginning. I now have photos of him with another woman, medical records showing treatment for an STd that he gave me and e-mails between him and his girlfriend and e-mails from his girlfriend to me.

    We are currently living apart. What are my chances of filing and having adultery charges prosecuted in Illinois against him? Do I need to file against his girlfriend and can I file against her?

    Illinois still has an adultery law on the books:
    Quote Quoting Illinois Criminal Code Sec. 11‑7. - Adultery
    (a) Any person who has sexual intercourse with another not his spouse commits adultery, if the behavior is open and notorious, and

    (1) The person is married and the other person involved in such intercourse is not his spouse; or

    (2) The person is not married and knows that the other person involved in such intercourse is married.

    A person shall be exempt from prosecution under this Section if his liability is based solely on evidence he has given in order to comply with the requirements of Section 4‑1.7 of "The Illinois Public Aid Code", approved April 11, 1967, as amended.

    (b) Sentence.

    Adultery is a Class A misdemeanor.
    However, typically such statutes are rarely enforced. The only real way to find out if Illinois will pursue charges is to file a police report and see what happens.

    Default Crime of Adultery in Illinois

    Well - why is it a law ?? If it is not enforced? If it was enforced people would think twice before marrying someone they claim to love and then totally ruin them in every possible way due to adultery. There would also be less STD's floating around and infecting innocent people due to their trust in their lying, cheating spouse.

    Are there any cases in the State of Illinois, on record??? Where the faithful and trusting spouse won???
