    Default Medical Treatment Outside of Comp Plan

    My question involves workers compensation law for the state of: Missouri

    Have en employee who has been treating for a comp injury with doctors who is not sent to by the comp program. I know he has to pay for that out of pocket, and I also know that our standard health insurance is not supposed to be paying for treatment related to a comp injury. Our health plan administrator has not figured this out. Can I, as the employer, alert them to this fact? Any authority on your answer? Thanks.

    If the employee is paying for his own care out-of-pocket, he can do that.

    If you believe that your employee is seeking workers comp care through regular health insurance instead of worker's comp, I don't see any reason why you couldn't share your concerns with your health plan administrator.

    If you want legal authority, hire a lawyer. No offense, I'm not going to research your state's statutes and case law over an issue this petty. At least not for free. I wouldn't expect to find any relevant authority.
