    Default Can I Have My Case Reopened and Changed from a B to a C Misdemeanor

    My question involves malpractice by a lawyer in the state of: TX..I retained a lawyer to defend me in a DWLI,(driving while license invalid) case. It was my first offense of any kind. My license was rendered invalid due to an unpaid ticket in another state. Note: I had no idea that my license was invalid.

    At the time, I trusted the lawyers instruction and accepted deferred adjudication with probation. It now appears on my record as deferred/dismissed Class B misdemeanor. I'm now learning that this is tantamount to a conviction in TX and is precluding me from various careers.

    Do I have any recourse with the court or can I address this with the attorney who really didn't do anything to "defend" me?

    Any help would be appreciated

    I believe the best you can hope for at this point is sealing/non-disclosure. Interesting paper on that here:

    You have no recourse against a lawyer just because you have regrets about the consequences.
