    Default Reckless Driving on Private Property

    My question involves a reckless driving ticket from the State of: Ohio

    back in june 2009 i was at my local taco bell and me and a friend were leaving the establishment. at the end of the parking lot i decided to try and burnout in my 06 dodge ram.

    I got a little spin but came to a complete stop when i finished and pulled out rather fast but i made sure no traffic was coming from my left. I get right to the next business and i was pulled over.

    The cop gets out of the car tells me what i did was stupid and i should of known better but never really tells me what i have done just says i was being stupid.
    He gives me my ticket i go home dont bother going to court so i just paid it.

    Now i just recently applied for a job and they background checked i told them no criminal history, they sent me a copy of the report and it came back a misdemeanor from that ticket, also i am in the military and i didnt think it was a big deal but with my job... military police i am kind of worried about losing my security clearance also.

    I need to know if i should try to get it expunged or what i should of done even though there is nothing i really can do now

    also the cop was about 100 feet away at a business to the right and the exit of the tb was kind of blocked by trees

    You may be able to get this conviction expunged. The State of Ohio has a web site on expungement. I recommend their Understanding and Sealing Records in Ohio brochure.

    Keep in mind that expunging does not remove the conviction from your record. It seals it, so that most employers and agencies will not see it. FBI background checks will always see the conviction. Commercial background checks will not see it.

    "Street racing" is a prohibited offense that cannot be expunged. What was your specific conviction?

    Also, traffic offenses can never be sealed, but they are not counted as a criminal conviction unless it is one of the prohibited offenses (such as "street racing", DUI, hit-and-run, et al.).

    There is something you might be able to do, but you'll probably need an attorney. Basically, you'll need to make a Motion to Set Aside Judgment and a Motion for a New Hearing. I don't know if that is even possible, given that it took place two years ago, but a quick consultation with an attorney couldn't hurt. A lot of attorneys will give you a few minutes free of cost. Check your Yellow Pages.
