    Default Warrant for Arrest Over a 10 Year Old Ticket

    My question involves traffic court in the State of: Texas

    When I was 18 (I am now 32) I received two no insurance tickets back to back in the state of Texas. I moved out of Texas a few months later.

    I received a post card April, 2 2011 from Tyler Municipal Court Fugitive Apprehensive Division informing of my warrant for my arrest for traffics tickets.

    Are traffic tickets written off after 7yrs?
    Can the state of Texas arrest me in California?
    They also have my name wrong on the addressing of the letter. Can I use that in my defense?

    That can be bad. It can prevent access to jobs, access to government backed loans, SSI and welfare, etc.

    Apparently not. Why should they?

    If they enter the warrant into NCIC and indicate that they want to extradite, sure.

    Nope.

    Can the state of Texas arrest me in California?
    Nope. It's also unlikely that they will move to have you extradited (it's pretty expensive), but if you set foot in Texas ever again, you risk arrest. No, the warrant will not expire.

    Only if your name is John Smith, but it's addressed to Joe Public. A typo such as Jon Smithe is not going to help you.

    Regardless of whether you intend to return to Texas for any reason, you need to get this sorted out. You'd do well to pay the outstanding fees.

    I don't know if traffic tickets are written off but you aren't dealing with a traffic ticket. You are now being charged with failure to appear which is a totally separate charge from the traffic tickets. So, you can either pay the tickets which will result in the recalling of the warrant or you can refuse to pay the tickets and be faced with a failure to appear charge. Whether you have a defense for the tickets or not is irrelevant at this point.

    apparently it was close enough that you got the notice. I suggest they won't really care when they arrest you, regardless of whether it is a valid defense or not (note: it isn't).

    Can the state of Texas arrest me in California?
    No but the California authorities can and hold you for transfer to the Texas penal system for prosecution if Texas so desires.

    Thank you for your response I appreciate it. I have started to look to see exactly what they are charging me with, but I am at a lost of what website I an search this information on. The post card said tyertexas.com, but that's not correct because it a tourist website.

    Is there a national database to search of out standing warrants?

    Yea I went through that site. Nothing there. I did find other states that have all the information on their sites, but not Texas.

    Although traffic tickets typically are "written off" after one year, the clock stops ticking as soon as they issue a warrant for your arrest. The probably happened as soon as you failed to appear. Arrest warrants never expire.

    From the postcard, it appears that Tyler Municipal Court is far more interested in collecting money from you than in arresting you.

    I suggest contacting them, find out how much they want, and make arrangements to pay them. You might be able to put it on a credit card over the phone, and be done with it.

    If you don't contact them, I suggest never visiting Texas again.

    It's a generic number to Tyler City. The communication has a half assed presentation. The other side has a sloppily hand written address. You'd think I'd get an official letter from the city.
