    Default Assaulted on Condominium Property

    My question involves injury or loss that occurred in the state of: Florida

    An obnoxious neighbor, with a history of complaints at our condominium, threw a full bottle of beer at me which broke on my forehead. I called the police and paramedics. They photographed the broken bottle on my terrace and the blood. I know the person who threw the bottle. Does the State proceed with a criminal assault charge.? What steps should I take to have him evicted?

    If the state finds that there is sufficient evidence to proceed with a battery charge, I expect them to do that.

    You are free to ask his landlord to evict him. You can also report the incident to the COA to see if they can or will take any action.

    Does the neighbor own his home, or does he rent? If he owns his condo, having evicted won't happen. You can sue him for damages, however.

    You could also go to the District Attorney's office, tell them you want charges pressed, and that you are a willing witness. Sometimes the D.A.'s office has to balance their workload with potential offenses, and minor offenses may not be pursued. A squeeky wheel can sometimes make the difference.

    You could also carefully read your condominium association's rules to see if you can find a reason to have him evicted. That might be possible even if he were the owner of the condominium.
