    Default Conditional Non-Release

    My question involves criminal law for the state of: Florida

    I recently purchased a gun from a gun show.
    I have been arrested twice before, both for drugs. One The second arrest has a felony on it. It was supposed to be dropped, and at the time of purchasing, I thought it was. Apparently it is not yet. I have also had an occupational background check done and it went through clean, so I figured I was alright.

    When I went to pick up the gun after the wait period, I was told there was a conditional non-release on my application and that I should come back in a few days to pick up the gun or I would receive a call saying I was denied. It turns out, when I came back the NICS had not contacted them back and the firearm was released to me.
    As I was leaving, the FLL told me that if I do get denied, they will come to me for the handgun.
    Now I am not looking to get arrested for unlawful possession of a firearm, especially when I was not trying to skirt around any laws, I tried to do this the right way.

    So what is my next step here? Do I try and return the gun to the FLL until my background check is done?
    Do I just hang on to the gun and see what happens?
    Or, after that 3 day period, has NICS defaulted and the gun approved?

    I wish I didn't take it from the store!

    For advice on how to handle the firearm while this remains pending you need to consult an actual lawyer. All we can do here is suggest that you err on the side of absolute caution - if we suggest anything else based upon a couple of paragraphs of information we would be acting rashly and putting your liberty at risk.
