    Default Coming Back After Missed Court Date - Non U.S. Citizen

    I am wondering on behalf of my sister. She was arrested in New Jersey during a trip to the U.S., for possesion of drugs and in custody for about 3 weeks in 2008.
    She was released on bail and then went home to Europe, then failed to go back for her court date. So she is not officially deported.
    My question is - what would happen if she was to go back? I am not sure how serious her offence was, her bail was pretty low and she had no problem going home.
    Would she have to pay a fine for not showing up in court? How much?
    Would she be let in or sent back right away? Or would she be taken back into custody until a new court date?
    Is there a barring for this, pre-convicted? What time-span is this. And what is the usual deportation time span for a minor offence?

    Sorry a lot of questions here, but it´s been really hard to get an answer from anyone. I would very much appreciate any kind of help.

    She needs a criminal attorney in the jurisdiction in which she was to appear in court. She likely has a warrant for her arrest for failure to do so. She should not attempt entry without seeking the advice of the attorney.

    In the US, drug offenses can have serious immigration consequences and should never be considered "minor".

    Thank you for your answer.

    Is there a time-limit to how long there would be a warrant for her arrest? Could she wait until this is over and then re-entry?

    Also, I might mention, allthough she is not an american citizen now, she has been as our father is american and she lived in the U.S. her first year. Upon her 18th birthday she had to choose on of her two citizenships and chose the non-U.S. one.
    But now it is possible to have dual citizenships so does this make any difference in her case?

    Warrants have a nasty habit of NEVER going away. Once charges are filed, she has to answer to them.
    Citizenship has no bearing on the criminal prosecution.

    And as far as the US goes, if she was a US citizen, she probably still is? The US forces no such "decision" at age of majority. The foreign country might. SHe would have needed to leave the US and specifically take actions to renounce her US citizenship. Whether she was ever a US citizen depends on information that hasn't yet been related here.
