My question involves real estate located in the State of: Texas
My father's widow is the "Life Tenant" in my father's home (owned free & clear prior to their marriage). She also maintains the Homestead exemption on her portion of the undivided interest. Me, my siblings, and all of our children are "Remaindermen".
After the first year of paying all the taxes, she has stopped paying the remaindermen's portions. To my understanding, the "Life Tenant" is responsible for Insurance, Upkeep (Maint.) and all taxes. The taxes on the remaindermen's undivided interests are now two years behind.
What are our rights? What Statute No. can I refer to? How should we proceed? Any help is greatly appreciated.
