    Default Child's Medical Bills and Payment

    My ex and I live is different states and neither of us live in the state that issued our divorce and child custody/support. It was court order that any medical costs that are not covered by insurance be split between us. My child need braces now. My child is covered by his fathers insurance and my insurance, however there will be some out of pocket cost. Father is refusing to pay his part. Can I sue him in small claims court or do I need to take him to family court. I need some advice that doesn't cost me to much.

    You need to tell us where you both live and from where the most recent orders originated.

    You may end up having to pay for the whole thing yourself and either suing Dad in small claims, or filing contempt in family court.

    I currently live in North Carolina, he lives in VA and the order orginated in North Dakota.
