My question involves real estate located in the State of: Florida
I've been trying to get help for my issue but no one seems to want to do anything. I have lived in my house since 1998 and at the closing, my agent said we owned an extra 20 feet of my neighbors property, which was a surprise to the previous owners, since both properties are enclosed by a chain link fence. The title clearly shows 20 feet past the fence seperating the yards is my property. On this 20 feet of land is the outer wall of my neighbors garage, half his driveway, a shed, and 2 wells. Between work and expecting our first child, life went on and it was forgotten about until approx a year ago when my neighbor approached my wife and said she had to sign a quick deed before the first of the year so he could get it filed and fix the issue. We didnt sign and he got nasty. Well my dads wife is in real estate and did some research. We found out his father owned both properties and seperated the land and built our house on the 2nd part. My neighbor used to be a surveyor, he worked for the company that did the survey for the title company used in the transaction, so he took care of the original boundaries. The county took 20 feet from the front of his yard so I guess he figured he would take 20 feet of my property, but didnt file the correct paperwork. My neighbor took the letterhead from the company he used to work for and made a fraudulent paper he filed with the county, saying his property is 163 feet deep. My property according to the title company is 143 feet deep, but between the fences is only 123 feet. And the 163 would also include the property the county took from him. He has moved the markers to make it look like they were put where the fence currently is, and he dug up the one's on the opposite side of my property. He has even threatened to take down the fence we share, claiming its his but in all his descriptions there is no mention of this fence, plus the good side is facing out so I've been told this is my fence. I've also been paying taxes on the 20 feet of land since I've lived here, which he says is also false. We spoke to the title company who insured the property and they are dragging their feet on it, and the county tax office says everything on record shows its mine so whats the problem. The problem is there is a fence up, which we dont know who owns it, and I cant have access to my property. We saw a lawyer and he said there is a good chance he can claim its his since its been so many years, but I dont accept that since he fraudulently filed papers on it and I'm paying taxes on it. And if this guy really owned the land as he claims, why did he want us to sign a quick claim deed?Can anyone point me in the right direction so I can resolve this issue and not have to worry about my neighbor anymore.
