    Exclamation Bar Fight - Assault and Trespassing

    My fiancé and I were out celebrating our engagement and some friend’s birthdays in April when a bar fight between my fiancé, his friends and the bouncers occurred. Tina and I were dancing on the bar b/c it was free shots if you dance on the bar. The bouncers have to put us on and off the bar. Dave was not aware of this because he hadn’t been there before and we had. Dave went to get Tina off the bar and the bouncer started yelling at him. In the meantime, Tina and I got off the bar on our own. After a few words between Dave and the bouncer the bouncer told Dave that he and his friends had to leave. My fiancé then told the bouncer we were there celebrating and that Dave hadn’t been there before, etc… My fiancé never once got smart with him. The bouncer pushed my fiancé out of the way and when Dave and his cousin Josh saw this, they started throwing fists left and right. Since my fiancé and I are regular’s to the bar (we get in for free since I am an EMT), the bouncer we know got my fiancé out of the fight and kept him to the side with me. Meanwhile Dave and Josh were seriously fighting with the bouncers, they had them fairly bloodied up.

    After they were escorted outside, Dave and Josh were handcuffed immediately. It wasn’t until about five minutes later that the bouncer remembered my fiancé when he saw him standing there and they handcuffed him as a partner in crime.

    They were taken to the police sub-station and given an arrest notification to appear in court for assault against a person. My fiancé never assaulted anyone. He was the person they started it with and he never got any punches in due to the fact that the bouncer we know pulled him out of it. The police did not check any of the three boys ID or records and they let them go with an arrestnotification and a court date.

    Here is the thing; my fiancé has never been in trouble before, one ticket in ’99. Our friend Dave has assault charges on his wife and Josh has drugs, assault, etc. on his record. Jarame does not want to be classed with these people in the courts eyes. My fiancé got a continuance to August 1 from his June 20 court date and now we are lost as to what to do since we cannot afford an attorney. HELP!! I am sure we cannot get another continuance. When we arrived at his court date, the docket stated 'Assault on a Person' & 'Trespassing on personal property' (which was not listed on the arrest notification). Don't the police have to tell people everything they are being charged for on the arrest notification? My fiancé also had nothing to do with the fight and busting the bouncers all up!!!

    Has your fiancé tried to get a court-appointed lawyer?

    Who is claiming that your fiancé committed an assault? That is, in the police reports and incident reports, who did your fiancé supposedly assault, and what does that person (or those people) say about what happened?

    I wish we knew what they are accusing him of and who. We tried to get a copy of the police report to see what it reads and they won't release it to us. The Police Dept. stated that we have to have either a lawyer who represents him get it, or we have to get a copy of it from the prosecuting attorney. When we went to court June 20th, they didn't have a copy of the police report at all. Therefore I am unsure as to what the police report states. However, we don't want to take the chance of anything happening. We just built and moved into a new house and we don't have the funding for an attorney at this time.
