    Default Can I Sell a Contractor's Equipment That He Left on My Real Property

    My question involves personal property located in the State of: Tennessee

    I had a tumultuous relationship with a contractor, including, among other things, a job that was never completed and some equipment left on my property after the work itself was seemingly abandoned. Can I treat the equipment as "Abandoned" under Tennessee law, and sell it/dispose of it as I wish? I would love to sell it, but most importantly I want to remove the equipment from my property.

    A few additional facts: The equipment has been left on my property for less than a year and I have not heard from the contractor, as he has made no attempts to contact me to pick up the equipment and my attempts to reach him by phone and mail have been unsuccessful. Any advice would be greatly appreciated.

    It looks like the owner has three years to bring a legal action from the date you take action to deprive him of his legal ownership:
    Quote Quoting Tennessee Code, Sec. 28-3-105. Property tort actions — Statutory liabilities.
    The following actions shall be commenced within three (3) years from the accruing of the cause of action:
    (1) Actions for injuries to personal or real property;

    (2) Actions for the detention or conversion of personal property; and

    (3) Civil actions based upon the alleged violation of any federal or state statute creating monetary liability for personal services rendered, or liquidated damages or other recovery therefor, when no other time of limitation is fixed by the statute creating such liability.
