Pregnant By Somebody Else While Married - Who is the Father

My question involves paternity law for the State of: Virginia

i was with a guy for a little while and got pregnant. well, i messed up the relationship and we broke up. soon after, i got married. i didn't have contact with my ex anymore after we broke up. well, my beautiful baby girl was born and since i live in VA, i had to give her my husbands last name (that is right, right?). he nor anybody signed the birth certificate. she is nine months old now and i have still not had contact with my ex. who is legally her father BEFORE ESTABLISHING PATERNITY? (i am never going to get a DNA test or court)

You were married when the baby was born. Your husband is the child's legal father.

You do realize, of course, that if the biological father wishes he can ask a court to force you to produce a DNA sample from your daughter... right?
