    Default How to Take Temporary Guardianship of a Minor

    My question involves a child custody case from the State of: MISSOURI

    My best friend is having difficult times with her 13 yo daughter. Either I take her or she is putting her in foster care or will wind up in juvie for any number of things. I am sure this is just because tempers are running high and the fact they are living in a high crime area and inner city children are her only peers (they have only lived there 6-9 months). Her mom says this is permanent but I bet once they move and tempers cool down she will get to missing her and want her back.

    So the question I have is what kind of paperwork do I need to have her living in my home so I can make the decisions needed for a teen. School, medical, physiological, drivers license, etc etc.....

    What do I need temporary or possibly permanent.

    He has no custodial rights or privileges at this time. Not that her being with a man out of prison that is on meth or coke that has a violent temper and has been proven to have had incestuous relations with his sister and possibly mother is a good place for her to live. Not to mention he recently kidnaped her and took her 1500 miles across several state boarders.

    Dad kidnapped the daughter??? What charges is he facing?

    The 13 year old needs to be in counseling immediately.

    Check with your school district to see if temporary guardianship is enough to enroll her in school.

    Thanks for the parental advice I wouldn't have thought to put her in counciling. I need LEGAL advice for me not him I don't care what charges he faces. I need to know what papers I need.

    Legally, it matters ALOT if he is facing charges. If mom no longer wants to parent her child, dad is next in line for her. Dad has the legal right to parent his child. If he doesn't agree to her placement with you, it won't happen; unless, of course, there are charges/convictions against dad that have caused the court to limit his rights. The child cannot live with you without the consent of both of her legal parents or a court order following a hearing where the parents can object.

    If you do get placement, the school tends to have the toughest requirements -- you need to ask your district if they accept temp guarianship. If you are planning on sending her to private school, then temp guardianship will be enough.

    The point is, he still has parental rights.

    The charges could be VERY important.

    Because frankly, HE could object to the guardianship.
