    Default Accidental death insurance claim

    Hi,my father died 10 years ago from a accidental drowning while tubing at a river. anyway he and my mother was divorced and he never remarried,plus i was his only child. any way i just found a accidental death insurance policy and i called the insurance company and they told me that the policy was paid up thru his death, of course they sent me the proper forms and requested i send them a newspaper clipping and autopsy report and police report, and the death certificate. i sent it all back to them and all the papers i sent all say accidental death due to tubing down river. no-one knew the policy existed, he had been paying it out on his montgomery ward credit card.
    of course they asked my why the delay of 10 years in filing this claim and i explained to them that no-one knew it existed. any way my question is this, do you think they will pay off being its been 10 years and i was and am his only next of kin?

    I don't think that it is possible to assess the chances of a payout without knowing both the laws of the state in which the contract was entered, and the terms of the policy itself. If the company won't pay, consider having the contract reviewed by a local lawyer who assists with insurance claims.

    Hi arron, I think they are going to pay the policy claim because today i recieved a letter from them stating that they need my mothers and fathers divorce decree. I will keep my fingers crossed and thank you in your input in this matter.

    lking, IF this policy was paid up till your father's death and it was because of an accident as you say it was. There should be no reason this policy would't pay. Usually the only reason accident policies like that wouldn't pay wouldn't be of a felonly if something illegal was going on at the time. I sell insurance for a living and I've ran across this before. Most of the time we run across old accident policies that people think are Life Insurance policies and they die of natural causes and unfortunately they find out they have no coverage or they have an accident policy or life policy they have let run out of the grace period and in most policies some or all benefits are gone at that point. One thing to think about, you may be eligible to receive interest on that accident policy as well. I know that with my company on a life policy after 30 days and if a claim isn't paid they pay 8% interest. That should be in your policy. Good Luck!

    One other thing, the last thing I would do is get a lawyer involved. They will just cost you money. Insurance agent's don't charge you anything for working out claims. I understand what Aaron is saying but, I would try the other avenue first. If you have problems contact the state Insurance Commissioner where you live first.
