    Default Injured Truck Driver

    I am a truck driver, over the road, got hurt in January broke heel on left foot have been recieving workmans comp. Doctor is releasing me to go back to work with permenant restrictions, of which are no lifting greater than 20 pounds, no climbing, limit ambulation. Dr. said later on will need surgury . My company is 5hrs. away of my home, so I can not come home everynight with a ofice job. dr. sid he would be filling out papers for a loss for settlement advised us to seek legal advice. can they stop workmans comp. checks, to where I have no income. and since this is a permanet loss am I eligeble for disability? I live in the state of Oklahoma. I am worried about loosing my house. I am 46 years old. rlain@cox.net Thank You.

    Are you eligible for what "disability"? If you believe you qualify for Social Security Disability benefits, you can apply for benefits with the Social Security Administration. If you mean through a private insurance policy, that will depend upon the terms of the policy.

    As for "can they stop workmans comp. checks", why would they do that? Is there something which leads you to believe that they will do so, or that they will contend that you no longer qualify for comp benefits?

    They have stoped the workman's comp checks because the Dr. released me even though I am not able to go back and do my job with my restrictions. I am now waiting to see what the Dr. says my loss is so they can offer a settlement. I am guessing they do not have to keep paying untill a settlement is offered. Maybe you can tell me thank You.
