    Default Regaining Firearms Rights After a Mental Health Hold

    My question involves public health law in the State of: california

    I was put on a 5150 which became a 5250 by the VA. After I left the hospital I later found out that
    5250 comes with a lifetime federal ban of firearms. I wish to own a firearm in the future and my illnesses are not permenent or anything serious, just was having a hard time. I wanted to know if their was any way I could fight this and get rid of the lifetime prohibition. I remember getting seeing a bill passed by the govenment (I think it was HR 2046 the so called veterens disarmement act) saying I could apply for a relief from disabilities and have my firearm rights restored can anybody help me with this?

    Interpreting that to mean that you have federal mental health restrictions on your firearms rights due to the manner of your detention, you presently have no remedy under California law.

    The federal statute providing for restoration of rights can be found at 18 U.S.C. § 925. At present it's not even worth attempting to analyze your situation under that statute to see if it might offer relief, as Congress has failed to appropriate funds for that remedy in over a decade and shows no sign of doing so in the imminent future. As a result of the complete lack of funding, nobody can presently get relief under that statute.
