    Default Threatened With Termination of Guardianship After Stopping Visitation

    My question involves guardianship in the State of: Arkansas.

    I have full legal guardianship and custody of my niece. my sister willingly signed it over to me a few months ago however i have had my niece since she was 6 weeks old, however my sister would come take her as she pleased for a day or two every once in a while. she will be a year old this month. She finally signed it over when some one called DHS on her for smoking in the car with the windows up with the baby, doing drugs around her , hitting her in the mouth, giving her benadryl to sleep and screaming in my nieces face. my sister is schizophrenic and bipolar and refuses to take meds she will tell anyone who will hear it that she hates my niece and she wishes she would have had an abortion. after we got all the paper work done with the lawyer and thru the court my sister started telling me she was going to still take her when she wanted and that the guardianship ment nothing because it was her " F***ing kid". i tryed for 3 weeks to let my sister come over an see my niece and spend time with her and she would come over scream in the babys face call her worthless and just be plain cruel. I put a stop to her visiting when she hit my niece in the head twice and mad her have a knot.. she then tryed to run me over a few days later. She is now texting me telling me she is takingme to court an will get my niece back. I have not a doubt in my mind if she got her back she would kill her.. she is seriously mentally unstable and needs help. so my question is: what is the likely hood of my sister getting her back?

    It honestly depends on how much of her abusive behavior has been DOCUMENTED (ie police reports, DHS reports, etc.).

    So has your sister actually gone back to court?

    Have DHS completed an investigation?

    Is there a case plan for your sister to follow?

    my sister has never been to court she signed papers saying she didnt want to go to court she signed a waiver and gave me all custodial rights. DHS asked her to come in a few months ago and bring my niece an she wouldnt take her so i went with them. they told her she needed to take a drug test and she said she would fail, so they told her she would have to do random drug tests, parenting classes, and take her medications and she refused, the next day shetold meshe wanted to sign her over to me.. like i said i have had her for her entire life already. after i got the custody stuff finalized, i went to DHS bcthey needed a copy of all my paper work, the supervisor of dhs in our county told me i didnt need to let mysister see the baby and that they were closing her case since she had no rights to my niece..

    I'm sorry, but we really need to get something clarified.

    Unless Mom's PARENTAL RIGHTS were terminated by a court, she still has the right to file for custody of her child at any time and to get visitation.

    Please go back and see what your paperwork actually says - were Mom's rights terminated, or did she simply lose CUSTODIAL rights?
