    Default My Illnesses Aren't Being Considered in My Divorce

    My question involves malpractice by a lawyer in the state of: California. My divorce has dragged on for 4 years. At the time of my testimony, I knew I was ill but had not been diagnosed. I don't even remember most of the questioning nor my responses. I have since been diagnosed with several conditions, some that would cause me to have anxiety and interfere with my decision making abilities. Toward the end my attorney became unresponsive and ultimately resigned. I find that most of my interests were never even addressed. The final judgment has not, to my knowledge, been submitted to the court. I need help! Where do I go from here? Can I recover the legal fees paid to the deadbeat lawyer?

    I'm confused.

    Why are your health issues the attorney's problem?

    Why do you believe you would be entitled to recover attorney fees paid for work your ex-lawyer performed?

    You are free to hire a new lawyer and it sounds like it would be sensible for you to do so, particularly if you're claiming that your mental capacity is diminished by your illnesses.
