    Default More than one collection agency reporting same debit

    Ok here is the deal.. i owe bellsouth 372 bux. from when i moved out of state where i no longer used bellsouth, i disconnected my service but they keept charging me for dsl. this was like 3 years ago. i have sence moved back i have purchased a car and found that i have 3 collection agencies reporting that i have a debit to bellsouth. i know it is past the SOL in my state so they cannot take me to court. but do they have the right to post this 3 times to my credit report. i have no plans on paying bellsouth as the phone service it self was disconnected and this is a bill for dsl. and bellsouth does not sell dsl without phone service. i just cannot get this throught there thick head.

    Ok go here one of them is now marked paid when i checked my credit today to post this. Thanks ahead of time for any Help you give.

    oo and by the way i have called the collection agencies and offered to pay this as it would be easyer to just pay.. but they will not remove the collection from my record they will just mark it as paid.. so sence it is past the SOL for my state i will not pay it. i just feel it should only be reported once not three times.

    once a debt has been recalled from a collection agency or they give it back to the Original Creditor, the CA no longer has the right to report anything regarding that debt on your credit report. the most entries you should have regarding any given debt would be two. you could have one from the original creditor and one from a CA with which the account is CURRENTLY placed for collection.

    Do you know what section of the FCRA covers this so that i may give referance to this when i send my letter to these other CA.

    also, is a printed bill valid proff of deibt in the eyes of the law. i sent a vod to the CA that had the account before NCO got it and about 3 weeks later i got a invoice from bellsouth with the list of charges. i was told by my coworker they must have a signature on file to keep the deibt on my credit report. (i dont understand this because no phone company has ever asked me to sign to get a phone.)

    your signature is required if they are claiming a contractual obligation other than your routine bill. they are required to show you how the amount was calculated. if the amount is accurate and you really owe the bill, i would either try to get ahold of bellsouth and make arangements to pay them directly (best option, if they'll let you), or to offer a "pay for delete" to the current collection agency. they may not accept and may keep coming after you. to sue you, bellsouth would need to bring copies of your monthly bills, not just a printed list, but chances are good that they have this info.

    I have read over the FCRA a few times and have not noticed where it says you cannot have more than one CA reporting the same account.. can some one point me in the right place.

    if the CA doesn't currently have your account, then there's nothing for them to report. they have to report "complete and accurate" information. if they don't have your acct, then they can't put it on there. it would imediately be inaccurate for them to claim you owe them money if they can't collect.
