My question involves a child custody case from the State of: Louisiana
Situation:
I am trying to get a passport for my 10 year old son. The biological father's name is on the birth certificate. We were in a relationship, but never married. He has been a distant part of my child's life. I have been married for 8 years and my husband has provided 100% for my son (Medical & Life Insurance, etc...) In 2003, the bio father was sentenced to Federal Prison. The only communication, I have had with him is through his sister. So I would say in a 10 year period, we have communicated 12 times. And he may have seen his son 5 times.
The passport agency expressed that since his name is on the birth certificate, I need a statement of consent from him on DS form 3053.
I have called and asked family if they knew where he was and noone could help. So I googled and found him in Virginia. I have mailed him the form twice, but I have not been successful in getting any feedback.
How can I get sole legal custody of my son?
