    Default Locked Out of Apartment

My question involves an eviction in the state of: ca

Hey guys! I got a civil case today! Turns out without either a 3 day or 30 day notice the landlord, NOT the leaser who illegally subletted the room to me - changed the locks. Who do I sue? The landlord or the sublandlord? I think I'm going to be filing against the sublandlord for all prorated rent from the 3rd to the 28th... then the landlord (or property managers)..the room mate on video spilled the beans on everything..very juicy evidence..do I have to give 3day notice now or can I just go straight to court?

Its illegal eviction for sure..id rather sue the property management co as I could collect off their business. Or do I sue the landlord? Do I just summon them all? Do I have to calll the police back and exercise my right to enter ? The pd gave me an incident number.

Summon them all and request a minimum of $1.6million.

    And your court costs.

Seriously though - you've given virtually no IMPORTANT information.

So do I file illegal eviction or do I have to post 3 days notice on his door now?

From what you've previously told us your landlord is taking the position that you were a house guest, not a tenant, and the police are accepting that position. If you want to file an unlawful detainer action, you have that right. You should be prepared to provide evidence of a tenancy when you go to court.
