    Exclamation What Happens when a Parent Fails to Appear for a Court Date Involving Child Custody

    My question involves a child custody case from the State of: CT

    My boyfriend was served by his ex for sole custody of his daughter. He filed for a continuance about a month ago because he wants full custody himself. The court date is coming up and she has stated that she will not appear because she does not have enough money to pay for a lawyer. What happens from there? Does custody go to the father?

    Generally speaking, she'll be given at least another chance to turn up - it's more than likely that the hearing will be postponed.

    If she fails to appear again Dad may well get sole custody by default - but Dad needs to be aware that default custody orders are not uncommonly overturned on appeal.

    The courts do prefer to give both parents a real chance at stating their case.

    Mom should probably understand that she doesn't necessarily NEED an attorney, by the way....

    The mom is fully aware of that fact. Thing is, the dad usually has her on the weekends...but for the past 3 weeks she hasnt picked up his phone calls or returned his texts. He had no clue of his daughters whereabouts. He even showed up at her apartment, but no one answered. We then went to a family members house to see if they had any information...nothing. We then found out that she hadnt been to work in three weeks without notice. We called the police but they said nothing could be done without an order of the court. We finally got into contact with her by using my phone number (which she doesnt know), so she was pretty surprised when she picked up. Supposedly she moved to NY because she found a better job, but never did she inform the father or the court about moving. Is there anything that can be done about this?

    We need to know:

    The CURRENT court orders and when they were entered;

    The age of the child;

    How far - distance-wise - Mom has moved.

    court order was for sole custody/child support not sure of the exact date...approx jan 6

    age: 2

    mom supposedly moved 2 hrs away but we have reasonable doubt that she has moved to FL (1200 miles away)
