    Default How to File Back Taxes After Divorce

    I recently (almost a year ago) divorced. My ex husband has his own company and my ex husband would not file taxes for at least 10 years while we were married. I was a stay at home mom and would work for him at home, but never received a salary or W2. He has no W2's either. What is best to do, file back taxes separately, married filing separately with no income, or do I need to fill in a portion of the income he brought in (we live in Maryland), or should we file jointly with a salary with no taxes due. I don't even know how much he actually made. I don't think there are any 1099's either. I need to move on with my life and consequently the mess that he has gotten me in and I just don't know how to fix this. We have kids together.

    I think he has received letters within the last two years from the Fed. Gov. for not filing taxes for a couple of the outstanding years and he has ignored the letters. Why hasn't he heard anything else or even been arrested yet????

    If you had no independent income, there is no need for you to file a tax return. He would have to file for those years using Married Filing Separately as his filing status, but that will not affect you.
