    Default Purchase Expensive Car Part, Never Came, Insurance Never Offered by Business

    I purchased an expensive car part about $1000 and shipping was $50 UPS. The insurance was never discussed since $50 for a lightweight product is a little high. They business now claims I never asked for insurance. I figured it was added since this is a high dollar/rare product.

    Anyways a month goes by and no product. dispute was made in paypal, but it doesnt seem it will go anywhere. they say they have a receipt that boxes were shipped, but unsure if the receipt, but who knows. do I have a case? do i have an actual chance at winning? I'm in southern California and they're in Michigan, where would I even file a small claims? Is it even worth fighting for? $1000 good is a chunk of change. Any advice would be helpful and greatly appreciated.

    There's either a UPS record that they shipped something to you or there isn't. If there is, then UPS will have records tracing the item from the time they received it up to the time they delivered it - if in fact it was delivered. So when you traced the package by shipping number with UPS, what did you find out?

    And no, sorry, you can't assume that a shipping and handling charge, even if absurdly high, includes insurance unless the vender states that it includes insurance.

    The seller has not provided with any information. No number no confirmation number or anything. They say they have a receipt where they mailed out a few packages that day but the receipt only show what they paid for shipping out a bunch of boxes. There is no real verifiable record from them. Even when requested there is nothing sent to me. Now they are refusing to give me my money back. There are only records of what the price we agreed on and my reciepts for payment. The business is now refusing to return any calls. Where do I go from here?

    I hope you succeed with your PayPal dispute. It's not credible that something would be shipped by UPS but that UPS would have no associated tracking number. (We're talking UPS, right, not USPS?)

    Sorry it's usps is what I'm told from that company. Apparently I just discovered they've had a few complaints. Selling parts saying the shipped it and somehow it's lost. Then thy get to sell the same part again. I emailed a couple of prior buyersand they lost also. Any ideals?

    I don't know the PayPal investigation process, but if you document to them that the vendor has failed to ship items to other customers that may help decide things in your favor.

    Where in Michigan is this company? (We may be neighbors. )

    For one, if the seller can not provide PayPal with a tracking number for the item shipped, (and that tracking number must display a shipping zip code to a destination zip code) and the buyer opens up a complaint with PayPal stating that he never received the shipment. Paypal will rule in favor of the buyer and will issue the funds back to the buyer if the seller still has the funds in his account.

    You have 45 days from the time you made payment on the item to open a claim with PayPal. You did open a claim with PayPal already, didn't you?

    i talked to my bank and it got involved withdrew the money from paypal back saying its unuathorized, paypal. then wants the amount and put a hold on my account. basically i found the seller, reposting the part that i bought online again. paypal says because a third party got involved, they no longer will handle buyer protection. my bank took money back but paypal wants it back. so basically i'm out 1000 the seller contacted me and said too bad and basically laughed at me and said its all my fault. how do i pursue this further and which court do i go to.

    I don't know now, you should have let PayPal do there thing, you would have won the case. But know your money is tied up for, who knows how long. Good luck.
