    Default Is it Malpractice to Fail to Diagnosis Cancer Early

    A family member was just diagnosed with Breast Cancer that has spread to back and other areas. All her Mammograms were "normal" and she has been to doctor after doctor complaining of back pain.(Obviously not knowing that the Cancer had already eaten up half her spine). Suppossedly X Rays were read as "Normal".She even had her Gall Bladder out due to the belief that was the cause of her back pain. There is a family history of Cancer.Any opinions on whether this is malpractice? Is it truly possible in this day and age for Cancer to go undiagnosed for years that it can spread like that when the person sees Doctor after Doctor?

    Thanks for any opinions.

    It is possible that it is malpractice - the failure to diagnose cancer in a timely manner can form the basis of a malpractice case. Whether medical malpractice occurred, though, is something that must be evaluated on a case-by-case basis under the laws of the state where the treatment occurred. Your family member should consider consulting a medical malpractice lawyer in that state.

    UPDATE:

    I hope this is okay to post here, but I wanted to say thank you. I had posted a few questions earlier and I was directed to where I needed to go.

    We are finishing up the discovery process now. After each depo, more errors were exposed and more blaming of each other. As I was warned, it is a slow, long proccess....
