    Default Selling Dads House, Do I Have to Disclose Possible Problems

    My question involves seller disclosure for real estate in the state of: SC

    Dad passed in August, we are about to put his house on the market. The house was built in the 40's by the original homeowner, no inspections. There were wiring and plumbing additions made to the house over the years. Possibly code compliant at the time, but do not meet code now. They were made before my Dad bought the house.

    I have noticed them while doing repairs on the house. Example: wires dropped through the floor to feed electrical on the additions. Undersized, improper plumbing. ETC.

    The problems pose no health or fire threats and will probably never give any problems. Dad lived there for 35 years and everything has been fine.

    Can we sell house "as is" ? If I disclose these "possible problems" it will drive away many buyers.

    then they are code compliant now as well. All previous work is grandfathered as a new code is implemented. If not, every house in the country would have to be constantly upgraded as codes change.

    you list it as is and complete the sellers disclosure honestly. Anything else risk being sued for misrepresentation if something is discovered later. Unless you know the code at the time of the installation, there is no way for you to know if anything is code compliant or not.
