    Default What is a Gag Hearing

    My question involves criminal law for the state of: Pa.
    I would like to know what a gag hearing 1 is and what a gag hearing 2 is?

    A Gagnon I hearing is a preliminary revocation hearing for a probation violation, to determine if the probation should be held in custody or be released back into the community.

    A Gagnon II hearing is a final revocation hearing, at which time the judge will determine whether or not a probation violation occurred and the sentence for any violation.
