Also, how are arrears calculated when there was no prior court order and is this legal? I am not sure how to approach the issue.
In Texas it's a straight percentage of the NCP's income.
20 percent for one child
25 percent for two children
30 percent for three children
35 percent for four children
40 percent for five children
Not less than 40 percent for six children
If you explain more about arrears, and what the NCP has actually been ordered to pay, and when...it might help us help you further

I look for several Texas Calulators. The one below tends to be the norm.
