Exclamation 16 year old dating 23 year old
Heres the deal...

Im 16. He'll be 23 in a month. We've been dating for 3 months and he lives with me at my parents house. My mom is disabled and bedridden and she doesnt know hes living with us, but my dad does, and is okay with it. We do have sexual intercourse, but im not sure if my dad knows. Like I said, im 16 and hes almost 23, is it illegal for us to have sex?

And one more question, if i got pregnant:
1. would he go to jail?
2. could the state take the baby from us?

My response:

You say that you're in Georgia, that your father is aware that he lives with you and your parents, but your mother doesn't know due to her condition. You say that the two of you are having sex - - undoubtedly, unprotected sex. So, my question to you is: Is this an actual "house" or a single-wide trailer?

I am not sure that's what she meant by "any input".

Quoting Georgia Code, Section 16-6-3
(a) A person commits the offense of statutory rape when he or she engages in sexual intercourse with any person under the age of 16 years and not his or her spouse, provided that no conviction shall be had for this offense on the unsupported testimony of the victim.

(b) A person convicted of the offense of statutory rape shall be punished by imprisonment for not less than one nor more than 20 years; provided, however, that if the person so convicted is 21 years of age or older, such person shall be punished by imprisonment for not less than ten nor more than 20 years; provided, further, that if the victim is 14 or 15 years of age and the person so convicted is no more than three years older than the victim, such person shall be guilty of a misdemeanor.
