My question involves criminal law for the state of: Florida A friend of mine is on felony probation in Florida and would like to move back to Missouri. Can her probation be transferred to Missouri or must she remain in Florida?
She needs permission of the probation departments in both states to do the move. She starts with her Florida probation officer. It can take several months to get it approved if it can be.
As a result of 9/11 the Federal Govt. took control over the interstate transfer of probation offenders. Unless at the time of crime you were visiting the state of Florida you must go through the ICOTS to transfer a supervision. The biggest issue is you can not be in the accepting state at the time of Application for Transfer. Second there must be Family willing to accept responsibility until the Offender gets on their feet. Generally, friends will not cut it. Application must be made through Florida. There is a time line of about 21 days for the other state to respond and if Accepted reporting instruction will be supplied. Federal law supersides state and a judge can allow transfer but can not authorized an individulal to transfer. Get all your duckies in a row and give it a shot.
