My question involves child abuse or neglect in the State of:

My girlfriend (or ex girlfriend) first of all suffers from a mental illness. there has yet to be a clear diagnosis however her therapist is leaning towards bi-polar or borderline personality disorder or both.

things are constantly up and down, she becomes manic, throws fits, runs off, can be completely irrational and irresponsible. my concerns are that she is 5 1/2 months pregnant, stress aside from this behavior, she is constantly turning to marijuana. this has been an ongoing battle from what i understand throughout her entire childhood. she dropped out of HS because all she wanted to do was party, she failed college for similar reasons. she is now 22 years old, pregnant, living at her parents, has no job and collects unemployment and smokes marijuana.

as the father of this child, do i have any legal rights to this child while it is in her? can i petition the any courts to drug test her now, should i call social services? how do i protect my unborn child who has no voice and no control over what her mother is doing. i am desperate in a search for advice on what i can do right now for this child.

secondly, the only proof i have of her using drugs are a few AIM conversations, some facebook emails, a journal and every text message her and i have exchanged since we found out she was pregnant.

when the child is born, what are my rights? if the child isnt given my last name what do i do until paternity is proven? her parents have assured me they will help act in the best interest in the child (meaning, if their daughter doesnt get her act together they will help me to get custody).

please someone help with any and all advice you have. im looking for a wide range of options so anyone with information, please share with me.
