My question involves a child custody case from the State of: PA
My ex and I split up 4 years ago after which time he moved from where we lived in AR to PA and left the children and I in AR. 10 months later we were trying to reconcile and the children and I moved to PA we lived there for 6 months and it didn't work for me I was all alone in the state and decided to take the children and move to my hometown. He then took me to court and received primary physical custody with us both having joint custody. I was told by a lawyer that he won because the children and I had lived in PA for 6 months or more and that became their legal residence. Since that time my ten year old was hit by a car because she was allowed to go to the park unsupervised and my 12 year old is allowed to run wild with her friends. My 10 year old is and has been so unhappy by the arrangement that she has begged for two years to move back with me and she has become such a problem to him that he is wanting to put her on a plane within the next couple of weeks. I want to make this legal because he is so vindictive he might get upset with me and just decide one day to take her back. How would we go about getting our custodial agreement changed and will we have to go to court and get lawyers or could we just write up a notorized agreement? I would really like to get all of my children back but I'm not sure how I could do that. If he is found in contempt for not going by our agreement could I get them all back?
