    Default Can a Deadbeat Dad Travel with a Revoked Passport Even Thought He is Not in the U.S.

    I have a child support order that was issued back in 2009 in the state of North carolina however the order was sent to Florida because that is the last known address for my husband (divorce pending). He never showed to court and shortly after left to Colombia(southamerica) with his pregnant mistress who lives there. He has NEVER made a payment and the person in charge of my case at DSS has told me the state of Florida has revoke his passport.

    Luckily I've been able to support my children on my own without any goverment help, but I do believe that they deserve to get something from him.

    He sent me an email not too long ago tellling me that he was going to start traveling for work, possibly to Spain from Colombia S.A.

    My questions are, will he be able to travel out even thought he is not in the US? can he come back to the US?

    I doubt that he will come back since he now has a daughter and a new family plus he now owes around $25,000 in arrears. Please advise. Thanks.

    Denial or revocation of a passport does not prevent the use of outstanding valid passports.

    You need to get a warrant for his arrest if you can. If he travels and goes through TSA, he should be arrested as TSA has access to the warrants section of NCIC.

    I doubt he has gotten a Columbia passport or that he can even legally work there. It is extremely difficult to get a work permit in any foreign country without residency status at least, which takes years.

    You might be able to do some digging, or have a friendly cop or da/sa and find out when he entered that country and what kind of a visa he has. If it is a tourist visa, he has to leave every 90 days generally.

    If he goes through customs someplace that can check the validity of a US passport, he would be denied entry and sent back where he came from. Generally though, in the third world they are just visually inspected and the info recorded.

    So He can use it to travel to any country until it expires, then he won't be able to renew right?

    No that's not what Mr. K meant. He meant that just because your husband can no longer use his US passport for travel purposes does not mean he can't use any other valid non-US passports for travel purposes.

    I found this information online, I guess they can prevent him from using his issued passport if they have revoked or set limitiation on his passport which according to Social Services it is revoked!

    Hopefully one day he will have to pay!

    42 USC §654 requires that each state establish and maintain a statewide child support enforcement agency for the purpose of obtaining, collecting and enforcing child support orders. In New York State, child support services are provided by the New York State Division of Child Support Enforcement (CSE) and Support Collection Units (SCU) in county and in New York City offices. Any court order of arrears or child support order referred to a Support Collection Unit is monitored and enforced by CSE.
    Upon notice to an individual in arrears, the enforcement agency may take several administrative actions to recover child support. This administrative action includes mandatory notification to HHS once an individual is in arrears of $2,500.00 or more. An electronic list is compiled of these individuals by HHS and forwarded to the U.S. Secretary of State for action. This action includes the mandated denial of any application for a new or renewal passport and the discretionary action of revoking, restricting or limiting a previously issued passport.

    Only if he tries to use it to return to the US (or leave the US).

    If he's traveling from Colombia to Spain, and never passing through the US, no one is going to stop him and take his passport away.
