    Default Speeding Ticket Took 28 Months to Get Court Date Plus Failure to Appear

    My question involves traffic court in the State of: Texas

    So I received a ticket in June, 2008. I requested a trial and called the court on 2 separate occasions July, 2009 and April 2010. The result of both calls was that the court had not yet set a date for trial, but that a date would be set soon. The next notification I received was a letter indicating that a warrant had been issued for my arrest in January 2011. I then contacted the court and they said that my court date had been set back in November 2010 and that I had failed to appear. I never received the letter from the court indicating a trial date. A couple of questions: Is any part of this covered by the Sixth amendent, right to speedy trial, even though I was never incarcerated? Secondly, do my actions appear to be those of a person trying to avoid court? I called them on 2 separate occasions. I've requested another court date for my now 2 causes and I'm pissed. The court wants to fine me for FTA plus my speeding ticket.

    Call the court and find out how you can see the judge ASAP. As long as you didn't do anything to excessively delay the case, it'll most likely get dismissed due to the extreme delay on the court's part. If you can pull up old phone bills with records of phone calls to the court, that would be a nice extra to show that you didn't willfully evade the proceedings.

    Why didn't you receive notice of the court date? Did you move?

    What was the reason for the delay in the filing of the ticket.

    Didn't move, have lived at the same address for 14 years.
    Court says, they had a backlog.
