    Default Restoration of Civil Rights in Florida

    I would like the right to own a firearm although I have one, maybe 2 problems...
    about 33 years ago I was charged with domestic violence in Florida because i slapped a phone out of her hand. No injury and no marks on her, went to court and plead no colo and adjucation was withheld. Possible problem #2, when I was 13 I threw a shoe at my mom in texas, I can't really remember what the charge was but I'm not sure if it would be a problem because there was no opposition when I got a secret security clearance in 2005 in the navy. Can someone with more knowledge/experience please help me because I believe that Florida will not expunge a dom violence charge and I'm not sure about the incident that happened when I was 13,I just wanna be able to carry a firearm.

    If adjudication was withheld, that means there is no conviction legally. I doubt a juvie charge amounts to a adult felony, but don't do criminal or family law so don't really know.

    I would say, do NOT purchase or attempt to purchase a firearm. Apply for a permit for concealed carry and if you get approved for that, you can legally buy a gun then.

    For purposes of the Lautenberg Amendment, once a deferred domestic violence case is dismissed it is no longer considered to be a conviction under that law. Obviously we know less about the Texas incident than you do. You may want to talk to a lawyer in Texas about the possibility of having your Texas juvenile record expunged.
