Can Commercial Enterprises Ask for Donations

I would like to ask if donations means that it's non-commercial.
also if donations means non-profit
example:
I have an application that uses icon that has a license that doesn't allow commercial use, may others donate to me? also - may others donate to me if i state that the donates are for the application itself and not for the icon that the application uses?

2.
Do advertisements means that a website is non-commercial?

, I am not sure the title you game to my post is the correct one - we are 2 (18 years old) guys who create a website, that website stores applications (which we create/created) - those application and this site are using content like: icons, sounds - we aren't trademark registered or something, though we don't want people to copy our work

I, for one, am not aware of any Israeli legal sites. To search for them I assume it would be helpful to be conversant with Hebrew.
