    Default I Have a Trouble Causing Roommate

    Hi- Sorry in advance for length...I rented a room in my apt. to a lady , that falsely presented herself as kind, approachable, trustworthy, friendly. But once she moved in the complete opposite is true.
    She's demanding, rageful, irrational, without logic, sense of entitlement, disrespectful and shows signs/behaviors of someone whom has bi-polar and OCD. She calls me vile names , both verbal and in writing. She's gone to my landlord in an attempt to ruin my reputation. (I've been in this building 19 years)
    I've had to call the police on her because of her rages. I've given her, her 3 months notice to vacate my room and because of my loss of trust in her sharing my internet, I have changed my password, but put in writing to her that I will reimburse her, her 2 months internet costs.
    I had her sign a 23 point, 6 month agreement with me. In which point 19 states that I can break the agreement if my subtenant displays signs of emtional/mental instabilities, for which she has 100%.
    She's now threatening to sue me and my landlord for disruption of service.
    My understanding is because she's renting from and has an agreement with me, not my landlord, does she even have a case against me? or my landlord?. Thank-you..

    Are you qualified to make a psychiatric diagnosis?

    You may find yourself in quite the precarious situation and perhaps should be speaking with an attorney.

    Why a 3 month notice? Are you nuts?

    Eviction notices are based on the period of rent payment, weekly or monthly.

    Reimburse her for internet costs? Dumb. No, she has no claim against your landlord.

    I seriously doubt she has the resources to sue anyone. If she did, she has not much chance of winning anything. She will destroy her own case if she acts that way in front of a judge. But seriously, there is almost no chance she will actually sue or have any chance of winning if you follow state law.

    It makes no difference if you are qualified for squat. Immaterial and irrelevant.

    Follow state law and evict her as quickly as possible.

    From what you have told us, it appears that you're her landlord (she's your subtenant) and that you can thus terminate her tenancy and evict her under the laws of your undisclosed state. If she's a month-to-month tenant and rent has been paid in full, that normally means giving one month's notice and, if she doesn't move by the end of the notice period, you may commence eviction proceedings. Some states allow for shorter notice; some states require notice to be a full rental period; some states permit notice to be given at any time during a month ending @30 days later. Many states require notice to be served in a specific form by a specific means. As you didn't follow the instruction to identify your state either time you posted this question, you'll have to look up the laws of your state to see what's required in your state. If she signed a lease for a specific term (six months, a year, etc.) you should expect that before the end of the lease you can only evict her upon a showing of good cause - and being rude or annoying generally isn't enough. If the police are arresting her or charging her in relation to your calls, that probably is enough.

    It sounds like you've already given her far more than she's entitled to receive - some form of payment or credit over Internet access, three months notice (if she's month-to-month)....
