    Default Legal Right to My Image

    Not knowing which forum to post I chose this one - if not the right one please advise.

    A company is using my image to promote their company even though I have sent them an email requesting they stop. What legal right do I have?

    BACKGROUND:
    I use to work for this company.
    I never signed anything allowing them to use the image.
    They obtained the image off my Facebook account.

    Time Line: in use for approx 1 month

    How Used: On their website and possibly collateral material as well as internet marketing campaigns.

    State: Florida

    A time line involves information about when each relevant event occurred.

    If I'm going to get information in dribs and drabs, all I can really do is say "consult a lawyer". It's going to depend on the facts. Perhaps you can't disclose enough information here without compromising your identity; I don't want to push too hard. But those answers are way too general to be helpful. It's possible that they have an implied license, or that you even granted tacit or actual permission, to use the picture during and perhaps even after your employment. For print materials, assuming they're involved, it's not surprising that they're going to use up their existing inventory before printing new materials without your image. You don't appear to be claiming that you have suffered any economic harm or loss, and absent registration your copyright case would be for actual damages.

    Dribs and drabs? I thought I was providing everything you needed. Please tell me what other information you need to help me.

    As far as the time line: I am on their website everyday, 24 hrs a day. Even as I write this and I've been on their website since Dec 1, 2010, hence the "approx 1 month." Is that what you are asking for? While employed there they stated they would use my image for internet marketing campaigns - I have no way of knowing or checking if this is actually occuring.

    I never made a verbal statement that they could use it but since I was a brand new employee I wasn't going to protest. My employment was for just 4 weeks. If you need more detailed info then please be specific
