Default Fight at school
Ok, let me start off by saying im 16 and am probation. I had an issue with a kid and told the principals and so on that he was going to assualt me and they did nothing. During class another day, He flipped and threw his chair and came over to attack me, I stood up and he swung. I tryed to restrain him but he was bigger and threw me to the floor so we started fighting and i hit back.

The teacher than called the officer who proeded to choke me and yanked me off by my throght and handcuffed me. The teacher wrote a report and stated that he had gotten out of his chair and threw it and came over to me. And said i stood up and we fought. Never said who swung first. Anyway I got charged with disorderly conduct. I don't think this was legal and Need advice.

I also got charged with violation of probation by truency because i got suspended for that incident. I am pending 6 months detention because of this and need legal advice..

I also forgot to add that I got a teacher to write a report staing that I told him 2 days advance that The student was going to fight me. Thanks for any replys

Default Fighting at School
Generally speaking, fighting in a public place can result in criminal charges. You seem to be suggesting that the other kid wasn't charged, but you also seem to suggest that you had the upper hand when the officer intervened, and you weren't cooperative with the officer's efforts to end the fight, so that may play a role in why you were charged while the other kid was not.
