    Default Can the Lease Be Voided if I Just Signed Last Week and Have Not Moved in Yet

    My question involves landlord-tenant law in the State of: TEXAS.

    My daughter and I signed a sub-lease last week right before Christmas. Circumstances are now that we cannot move into the house. The realtor tells me the contract cannot be voided. The "for rent" sign was never removed from the yard in front of the house. What can they do?

    They can sue the tenant(s) and cosigner(s) for damages, including the rent that accrues during the time it takes them to find a new tenant and, possibly, the difference in rent between the (market rate) rent that the new tenant is paying and a higher amount the tenant(s) agreed to pay for the duration of the lease.

    Review the document(s) you and your daughter signed to see if there are any provisions relating to early departure.
