    Question My Roommate Kicked Me Out of a House That I Own

    My question involves landlord-tenant law in the State of: AR
    On ---, --- and ---- came to me and told me that that they did not have anywhere to live and had heard that I had a job in another town. They asked me if they could stay in my house ( I am buying). I told them I really did not want anyone in my house because I would be coming home every other weekend and on holidays and my kids would be in and out. She said that would be no problem at all because she really needed a place to stay.


    Per verbal agreement, --- and --- would pay $300.00 a month for the two bedrooms, and be responsible for paying the gas, water, and electric bills. She also agreed to feed and water my pets. My children and I would have use of the third bedroom and on weekends and holidays. I would continue making my mortgage payments including insurance, internet/telephone and the Direct TV bill.

    We did come home on several occasions without problems, but when we came home for Christmas was when all the trouble started.

    She did not say that we are roommates or sharing the home. Now I have been kicked out of my own home with ALL of my belongings in my home.

    Of course I do not have this in writing – I have no lease or written renters’ agreement with them. She is the daughter of a friend of mine - I trusted her and agreed to this arrangement in good faith. There have been no previous problems on any other occasion that I have gone home.

    How can I get the police to understand this was a roommate agreement? Otherwise, I would not have left everything I own in my home.

    ALL of my belongings are in that house, except for a few clothes. I was coming home to get my furniture, pots, pans, etc to take to my new apartment. Now I have NOTHING and have to re-buy items that I already have!!! Can she be liable for the money I am out? How do I just get my belongings? The only thing she brought into that house was her clothes. She made my Christmas into a nightmare.

    This is what I get for helping someone.

    They told the police she is renting the entire house and told them I had abandonded the house. Give me a break!!! 300.00 a month for a completely furnished home and why would I leave ALL of my childrens pictures, food, clothing, etc.

    I CALLED the police and it just got me thrown in JAIL!!!

    Your tenant has no grounds to kick you out, nor does she have any grounds to keep your belongings.

    Serve her a three day writtne notice to vacate, then commence formal eviction proceedings. When was the last time she paid rent? If she has missed a payment, you can file for criminal eviction. Elsewise, it's a civil eviction. Read here, here, and here.

    I tried and was told a 3 day would not stand up in court. So she got a 10 day yesterday. I have an apartment with NOTHING in it because she has ALL of my belongings.
