    Default New Ticket Issued Months After Initial Court Date, Court Had No Record of Charges

    My question involves a traffic citation from the state of: Wisconsin
    I was stopped for an alleged OWI, took a breathalyzer then a forcable blood test and arrested. After being released without having to pay bail I was given a court date within thirty days of my arrest. I went to court only to find they had no record of my case though much to my dismay the clerk said the DA may have lost my file so he'd forward it back to the DA. Two months went by and I received a new ticket in the mail with a different court date written over the first one on a copy of the initial ticket. My new court date is scheduled for four months after my arrest. Is there a statute of limitations or any laws that require them to give me an initial court date in a timely fashion following my arrest?

    Your initial charge was apparently either dismissed or never formally filed.

    You don't have any speedy trial rights on a charge that has not yet been filed, and the statute of limitations doesn't run in a period of a few months.
