    Default Ticket for Improper Passing in New Jersey

    My question involves a careless driving ticket from the State of: NJ
    My wife was recently involved in an accident in Morristonw NJ. she was driving down a side street (no traffic lines painted but 2 way) The car in front of her put on it's right hand turn signal and got over to the right to make a right hand turn. My wife began to pass on the left to continue moving forward when the driver changed it's mind and cut the wheel back left causing my wife to hit the other drivers rear driver side door.

    Is it illegal to pass in this instance?

    Not enough information here, but most likely yes. It's illegal to pass in intersections. If this was only a single lane (in that direction road), trying to pass someone just because they are making indications of wanting to turn is also unsafe.

    What if the other driver did not just signal and make indications but actually began to turn pulling far enough over for a car to pass without going into the other lane? Also this was not a 4 way intersection just a right turn off a road. Not sure if that helps or changes it

    This was two lanes on a one way street with no painted road marking or two lanes on a two way street with one lane in each direction and no painted road marking separating the two lanes?

    This was a two way street with no painted lines. I guess technically it is two lanes, one in each direction.

    Your wife tried to pass by someone in the same lane. :/ Unless she moved over enough? Like, where the other lane would be? Because if theres dotted lines on a street like that, you can pass, so if she movied over into the other lane, this person can actually get in trouble for reckless driving.

    If it's the former that she just moved over enough so she could squeeze by him in the same lane, I'd assume it's not legal.
