    Default Car Vandalized in Apartment Complex's Garage

    My question involves an injury that occurred in the state of: California

    My car, along with every other tenant's whose car was in the apartment's garage at the time, was keyed. Our apartment complex's garage is gated and is suppose to be safe and secure. My question is - does the landlord have any legal responsibility since the vandalism happened on his premise? Can we claim the landlord's insurance for the damages?

    Pull out your lease and take a look as most have language that would have you be responsible. Normally, if you have insurance coverage, file the claim, and have your insurance handle it. I'm a landlord, and my leases would have me not responsible for the tenant's belongings as well as his vehicles. One tenant who failed to buy his own insurance as required wanted to have me file the claim on my landlord insurance, and I had him evicted for failure to follow the lease.

    Yes, you can sue your landlord for negligence, and then he'll have his insurance defend him, but don't expect to get paid easily if at all.

    The mere fact that somebody broke into your car in the apartment's garage does not, of itself, mean that the landlord was in any way negligent. Sometimes, "stuff happens."
