    Default Non-Custodial Parent is Resigning - What's the Impact on Child Support

    My question involves child support in the State of: Kansas
    (I accidentaly posted this in another forum, I'm sorry for the repeat. I thought I might get more replies if I put it in the right area).
    We have a court date for next month to modify child support. This past weekend my ex informed me that he is RESIGNING from his position he took in July. Before this, he was laid off from work for 1.5 years. Does anyone have experience with this? I know if they are fired or laid off, the courts say it was not their fault and reduce payments. But this was his choice. Child support is set at $60 right now and is suppose to go up with this modification request.
    Any information would be greatly appreciated.
    PS..I do NOT have a lawyer. Can't afford one. He does. (yes, he can pay a lawyer $200 an hour, but can't pay for his child.)

    Well, like I said there - the courts may not look kindly on a parent who voluntarily resigns and reduces income, pleads poverty yet STILL is able to pay an attorney $200/hour.

    Your ex might well be in for a nasty surprise once he goes to court. The court can leave things as they are, they can reduce - although I honestly don't see that happening - or they can modify upwards according to the NCP's potential earnings.
