    Default Issued a Parking Ticket for Parking Over Two Hour Limit - I Did in Fact Move My Car

    My question involves a traffic citation from the state of: California

    Hi, I received a parking ticket for parking on a sidewalk over the two hour limit. The only problem is, I didn't. I made sure to move my car one hour and a half after I had parked.

    Some background information: I parked in a spot immediately before a driveway. The place I moved my car to was the spot immediately after the aforementioned driveway. I have no proof and I am not going to pay for a wrongly issued ticket. What can I do? Thank you.

    edit: One important thing was also that this ticket was issued BEFORE the two hours were over.

    You can challenge the parking citation through whatever process is in place to do so. You give your story to the hearing officer or panel and hope they believe you. If you lose, then appeal and lose again, you have the option of going before a court. But, if you lose at court, you may then have to pay some court costs as well.

    Was the spot you moved to on the sidewalk as well? It's hard to tell based on your OP. How soon before the 2 hours was it issued?

    Yes, the spot I moved to was on the same sidewalk, only 15-20 feet forward from my original location. The ticket was issued approximately 45 minutes before the two hours were set to expire according to my watch.

    I've appealed it once giving evidence but I will appeal again, I suppose. It seems that if I do this second appeal, the burden of proof is placed on my shoulders? I'll have to go home and reread the ticket, but from what I recall, that is what it said in some form or another.

    edit: I just want to clarify that when I say sidewalk, I simply mean street parking if that makes any difference.

    You don't say what ordinance you were cited for, but in many places in California, you must move your car past the next cross street for it to be considered moved.

    Same with Philadelphia, if you do not move your car to another street before the 2 hours are up, you will get a ticket.
